1. Acceptance
By creating an account, signing in, or otherwise using the Dropping app (the 'Service'), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.
2. Nature of the Service
The Service helps organisers of scout-style 'dropping' hikes coordinate participants and exchange location data. It is provided as a coordination aid only and is not a safety, emergency, navigation, or rescue service.
3. No warranty
THE SERVICE IS PROVIDED 'AS IS' AND 'AS AVAILABLE', WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING (BUT NOT LIMITED TO) WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY, RELIABILITY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT GPS DATA, MAPS, CHECKPOINTS, COMPASS HEADINGS, CHAT DELIVERY, OR NOTIFICATIONS WILL BE ACCURATE, TIMELY, COMPLETE, OR UNINTERRUPTED.
4. Assumption of risk
Outdoor activities, hiking and 'droppings' are inherently risky. You participate at your own risk. You are solely responsible for your own safety, equipment, navigation, decisions, supervision of minors, and compliance with applicable laws and the rules of the organisers. Do not rely on the Service as your sole means of navigation, communication, or emergency response — always carry independent means (map, compass, charged phone, emergency contacts).
5. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER THE OPERATORS NOR THE CONTRIBUTORS OF THE SERVICE SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS INCLUDES — WITHOUT LIMITATION — HARM TO PERSONS, INJURY, DEATH, PROPERTY DAMAGE, LOST OR INCORRECT POSITION DATA, FAILED OR LATE MESSAGES, OR DECISIONS MADE BASED ON THE SERVICE.
6. Your responsibilities as a user
You agree to provide accurate information, to keep your credentials secure, to act lawfully and respectfully towards other participants, and not to misuse the Service (e.g. impersonation, harassment, unauthorised tracking, scraping, or attempts to disrupt the platform).
7. Responsibilities of hosts (organisers)
If you create or host a dropping, you confirm that you have the right to invite the participants you add, that you are responsible for the safety, supervision and consent of those participants (including minors and their legal guardians), and that you will use location data only for coordinating the dropping.
8. Location data
While participating in a dropping you broadcast your real-time location to your group and the dropping's host. By using the Service you consent to this sharing for the duration of your participation. You may stop sharing at any time by closing the app or revoking location permission, but doing so may make coordination and safety oversight impossible.
9. Content & chat
You are solely responsible for content you send through the Service. We may remove content or suspend accounts that violate these Terms or applicable law.
10. Availability and changes
The Service may be modified, suspended, or discontinued at any time without notice. Features may change, and these Terms may be updated; continued use after changes constitutes acceptance.
11. Third-party services
The Service relies on third parties (maps, geolocation, hosting, push delivery, authentication providers). We make no warranty and accept no liability for those third-party services.
12. Indemnity
You agree to indemnify and hold harmless the operators and contributors of the Service from any claim, demand, loss or expense (including reasonable legal fees) arising out of your use of the Service, your content, or your breach of these Terms.
13. Governing law
These Terms are governed by the laws of Belgium, without regard to conflict-of-law principles. Mandatory consumer protections in your country of residence remain unaffected.
